CHAPTER L9

LAWS AUTHENTICATION LAW

A Law to make provision for the Authentication and Recording of Laws passed by the House of Assembly of the Cross River State

(1st April, 1965)

[Commencement]

  1. Printing of Laws

A Bill for a Law to be enacted shall, when passed by the House of Assembly, be immediately set up in fair and legible type by the Government Printer and six copies printed from the type so set up on vellum or on paper of an enduring quality, shall be struck off by him.

  1. Authentication of Bills

The six printed copies referred to in section 2 shall be carefully compared by the Clerk of the Legislature with the Bill which has been passed by the House of Assembly, as the case may be, and, on being found by him to be correct, shall be authenticated by him in the words set out in Part 1 or Part 2 of the First Schedule, as the case may be.

  1. Presentation of Bills for assent

(1)     The Clerk of the Legislature shall, on the direction of the Speaker, present to the Governor for assent for six authenticated printed copies of the Bill and the Governor shall signify his assent to the Bill on each copy in the form set out in the Second Schedule, duly signed by him.

(2)     After the Governor has assented to the Bill the authenticated printed copies shall be returned to the Clerk of the Legislature who shall cause to be recorded on each of them particulars of the day on which the Law is to come into operation, or, if that day is not determined, a reference to a provision in the Law whereby it may be determined.

(3)     The six printed copies signed by the Governor containing the particulars mentioned in subsection (2) shall be the original copies of the Law.

(4)     Of the original copies of the Law, one shall be deposited with the Clerk of the Legislature.

  1. Sealing and dating of Laws

(1)     The Governor shall cause the original copies of a Law to be sealed with the Public Seal of the State and the date on which the Law is assented to by him to be indorsed thereon.

(2)     The Laws passed in each year shall be distinguished by consecutive numbers beginning in each year with the number one.

(3)     Laws passed by the House of Assembly and assented to by the Governor shall be dated as of the day on which the assent of the Governor is given but, whatever that day may be, shall be numbered as of the year in which they are passed.

  1. Copies of Laws promulgated

The copies of every Law passed in the first instance shall be impressions from the same form as the copy deposited with the Clerk of the Legislature.

  1. Enrolment of Laws

The Clerk of the Legislature shall transmit to the Chief Judge to be enrolled in the High Court an original copy, sealed with the Public Seal of Cross River State of Nigeria, of very Law assented to by the Governor.

  1. Publication in State Gazette

(1)     A Law assented to by the Governor shall be published in the State Gazette and shall come into operation—

(a)     on the date of the assent; or

(b)     if it is provided by that Law or by other enactment that it shall come into operation on some other date, on that date.

(2)     The Law so published shall have indorsed therein, in the words set out in the Third Schedule, the date on which it was assented to by the Governor.

  1. Laws to be published

As soon as may be after the commencement of each year the Clerk of the Legislature shall cause a complete collection of all laws enacted by the Legislature during the preceding year to be published for general information.

  1. Interpretation

In this Law unless the context otherwise required—

“House of Assembly” means House of Assembly of the State;

“Governor” means the Governor of Cross River State;

“State” means Cross River State.

  1. Short title

This Law may be cited as the Laws Authentication Law.
