OFFICIAL OATHS LAW
A Law to make provision for official oaths
(1st October, 1963)
[Commencement]
Where by a law, a person is required to take or subscribe an oath of allegiance, the form of oath shall be as set out in Form F of the First Schedule.
The Oath required to be taken in addition to the oath of allegiance by the Governor of the State before entering upon the duties of his office shall be as set out in Form A of the First Schedule.
(1) The Oath required to be taken and subscribed by a Commissioner of the Government or a Parliamentary Secretary to such a Commissioner in addition to the oath of allegiance before entering upon the duties of his office shall be as set out in Form B of the Schedule.
(2) In addition to the oath prescribed in subsection (1), a Commissioner appointed a member of Executive Council shall take and subscribe an oath as set out in Form C of the Schedule.
The Oath required to be taken and subscribed by a person appointed to the office of Chief Judge or Judge of the High Court in addition to the oath of allegiance shall be as set out in Form D of the Schedule.
A person appointed to the office of Magistrate or Justice of the Peace shall before exercising the functions of his office take and subscribe an oath as set out in Form E of the First Schedule.
An official oath mentioned in the first column of the Second Schedule shall be taken and subscribed before the person mentioned in the second column thereof.
This Law may be cited as the Official Oaths Law.

FIRST SCHEDULE
FORM A
Governor’s Oath
“I, …………………………………………………………………. do solemnly swear that I will well and truly exercise the functions of the high office of Governor of the Cross River State of Nigeria, that I will preserve and defend the Constitution of the Cross River State of Nigeria and that I will do right to all manner of people according to law without fear or favour, affection or ill-will. So help me God”.
FORM B
Ministerial Oath
“I, ……………………………………………………………………, being appointed to the office of a Commissioner of the Government of the Cross River State of Nigeria, swear that I will at all times well and truly serve the State in the office of a Commissioner; and that I will support and uphold the Constitution of the Cross River State of Nigeria as by law established; and that I will to the best of my judgment at all times when thereto required freely give my counsel and advice to the Governor of the Cross River State of Nigeria and his successors in office as by law established for the good management of the affairs of the Cross River State of Nigeria; and that I will not directly or indirectly reveal any matters as shall come to my knowledge in the discharge of my duties and committed to my secrecy. So help me God”.

Executive Council Oath
“I, ……………………………………………………………. , being called upon to exercise the functions of …………………………………………………. the Executive Council of the Cross River State of Nigeria, swear that I will not directly or indirectly reveal such matters as shall be discussed in the meeting of the Executive Council and committed to my secrecy. So help me God”.
FORM D
Judicial Oath
“I, ………………………………………………………………….. , swear that I will well and truly exercise the judicial functions entrusted to me and that I will uphold the Constitution of the Federation and the Constitution of the Cross River State of Nigeria and that I will do right to all manner of people in accordance with the laws and usages of the Cross River State of Nigeria, without fear or favour, affection or ill-will. So help me God”.

Magisterial Oath
“I, ……………………………………………………. , swear that I will well and truly exercise the judicial functions entrusted to me and that I will do right to all manner of people in accordance with the laws and usages of the Cross River State of Nigeria, without fear or favour, affection or ill-will. So help me God”.

Oath of Allegiance
“I, …………………………………………………………., swear that I will be faithful and bear true allegiance to the Republic of Nigeria and that I will preserve, protect and defend the Constitution. So help me God”.
