SCIENCE AND TECHNICAL EDUCATION BOARD LAW

A Law to make provisions for the establishment of the Science and Technical Education Board and for matters connected therewith.

(20th December, 1991)

[Commencement.]

PART I

Establishment of the State Science and Technical Education Board

  1. Establishment

(1)      There is hereby established a Board to be known as the State Science and Technical Education Board.

(2)      The Board shall be a body corporate with perpetual succession and a common seal and with power to sue and be sued in its corporate name and to own, hold and dispose of property whether movable or immovable.

  1. Membership

The Board shall consist of—

(a)      a Chairman and 3 other members, all of whom shall be appointed by the Governor;

(b)      the following ex officio members—

(i)       the principal of a Science or Technical School;

(ii)      a representative of the Polytechnic, Calabar;

(iii)     a representative of the Ministry of Works;

(iv)     a representative of the Ministry of Education;

(c)      the Executive Secretary to the Board.

  1. Tenure of office

A person appointed as a member shall hold office for a term of 3 years and shall thereafter be eligible for re-appointment for one more term of 3 years.

  1. Vacation of office

The office of a member shall become vacant if—

(a)      he, by notice under his hand addressed to the Governor, resigns his office; or

(b)      he is removed by the Governor for misconduct or any other cause.

PART II

Functions and powers

  1. Functions

The functions of the Board shall be—

(a)      to provide and develop science and technical education at post primary schools;

(b)      to provide vocational education for the training of artisans and craftsmen;

(c)      to set up, develop and manage, science secondary schools, technical schools and vocational schools;

(d)      to manage and control the schools and colleges specified in the schedule;

(e)      to ensure that courses of instructions given in the science and technical education scheme conform to the National Policy on Secondary Education as well as other educational institutions where students are likely to seek admission to further their studies;

(f)      to ensure that courses of instructions given in vocational schools and centres conform to the National Policy on the provision and promotion of vocational education in the State.

  1. General powers

The Board shall have power—

(a)      to appoint such staff, agent, employees and other workers as the Board may require for carrying out any of its functions;

(b)      to determine and approve scheme of service for all category of its staff and their emoluments;

(c)      to appoint, promote, dismiss and exercise other disciplinary control over its staff;

(d)      to acquire any equipment, materials, furniture and other properties required for purposes of the Board;

(e)      to acquire and maintain any premises forming part of the Board;

(f)      to draw up organisational structure for the Board;

(g)      to do all such other things as the Board may deem necessary for carrying out any of its functions.

  1. Powers of the Board to delegate its functions

The Board may appoint standing or ad hoc committees as the case may be, to perform on its behalf such of its functions as it may determine, but no decision of such committee shall have effect until it has been ratified by the Board.

PART III

Funds and accounts

  1. Funds of the Board

The funds of the Board shall consist of—

(a)      such revenue as the Board may derive from its investments;

(b)      such sums as may from time to time be granted to it by the State Government or the Federal government or any organisation, institution or agency;

(c)      donations, subsidies, gifts, grants from communities, organisations, associations, clubs and individuals;

(d)      fees paid to the Board; and

(e)      such sums as may accrue to the Board from any other source whatsoever.

  1. Account and audit

(1)      The Board shall keep proper books and statements of account in respect of its revenue and expenditure for each financial year.

(2)      The Board shall as soon as may be after the end of each financial year, submit to the Governor—

(a)      a report of its activities for the financial year;

(b)      the profit and loss account of the Board including the balance sheet for that financial year; and

(c)      the report of the State Director of Audit on the said account.

  1. Borrowing powers

The Board may, subject to such terms and conditions, as the Governor may approve, borrow by way of loan or overdraft such sums of money as it may from time to time require for carrying out its functions under this Law.

  1. Investment

The Board may, subject to such terms and conditions as the Governor may approve, invest in such securities as it may from time to time decide.

  1. Bank account

The Board shall operate a bank account in any reputable bank and all monies received on behalf of the Board shall be paid into that account and no withdrawal shall be made from that account unless the cheque or other instruments in respect of such withdrawal has been signed by the Secretary and the Accountant or such other persons as the Board may from time to time authorise in that behalf.

PART IV

Meetings

  1. Convening of meetings

(1)      The Board may on such date and at such time and place as the Chairman may decide, hold any meeting for the transaction of its business:

Provided that meetings of the Board shall be held at least once every three months.

(2)      The Chairman may at any time on his own motion and shall upon the requisition of any two members, convene a meeting of the Board to transact any business specified in the notice of such meeting.

  1. Presiding at meetings

(1)      The Chairman shall preside at any meeting of the Board and in his absence, the members present shall elect one of their number to preside at such meeting.

(2)      The member presiding at such meeting shall have a second or casting vote.

  1. Quorum

A meeting of the Board shall not proceed to business unless there is a quorum present and one third of the members present at such meeting shall form a quorum.

  1. Co-option of member

Where upon any occasion, the Board desires to obtain the advice of any person, on any particular matter, the Board may co-opt such person to be a member for such meeting as it may deem fit and such person shall have all the powers and privileges of a member except that he shall not be entitled to vote on any question or count towards the quorum.

  1. Validity of proceedings

The validity of any proceedings of the Board shall not be affected by any defect in the appointment of any member or the absence of any member or any vacancy in the membership of the Board, or by reason that a person not entitled so to do has taken part in such proceedings.

  1. Standing Orders

The Board may make standing orders to regulate its proceedings and those of its committees.

PART V

Miscellaneous provision

  1. Secretary

(1)      There shall be appointed an Executive Secretary to the Board who shall—

(a)      be an experienced educationist in science or technical education; and

(b)      be appointed by the Governor.

(2)      The Executive Secretary shall be chief executive and accounting officer of the Board and shall in that capacity assist in the formulation and implementation of the policies of the Board.

(3)      Without prejudice to subsection (2) of this section, the Executive Secretary shall be responsible for—

(a)      the day to day administration of the Board;

(b)      the maintenance of discipline among the students and members of staff of the Board;

(c)      custodying the seal of the Board;

(d)      carrying out such other duties as the Board or Chairman may from time to time direct.

  1. Remuneration of Chairman and members

The Chairman and other members shall be paid such remuneration as the Governor may approve.

  1. Authentication of documents

(1)      The common seal of the Board shall not be used or affixed to any document except in pursuance of a resolution of the Board duly recorded in the minutes of such meeting.

(2)      The fixing of the common seal of the Board shall be authenticated by the signatures of the Chairman and the Secretary or the signatures of any member generally or specifically authorised in that behalf by the Board.

(3)      Any contract or instrument which would not be required to be under seal if entered into or executed by a person, may be entered into or executed as the case may be, on behalf of the Board by any person generally or specifically authorised in that behalf, by the Board.

(4)      Any document purporting to be a document duly executed under the common seal of the Board shall be received in evidence and shall unless the contrary is proved, be deemed to be so executed.

  1. Directions by the Governor The Governor may give to the Board directions of a general or specific nature with respect to the performance by the Board of any of its functions and the Board shall comply with such directions.
  2. Representation in Court

In any civil action or proceedings, the Board may at any time be represented in court by a State Counsel or a legal practitioner nominated by the State Attorney-General.

  1. Regulations

The Board may make regulations for the carrying into effect of the provisions of this Law and without prejudice to the generality of the foregoing provisions, the Board may make regulations with respect to—

(a)      the appointment, promotion, transfer and dismissal of the staff of the Board and the exercise of disciplinary control over such staff; and

(b)      the conditions of service of the staff of the Board.

  1. The Cross River State Science and Technical Education Board Edict 1991 is hereby repealed.
  2. All assets and liabilities which immediately before the commencement of this Law were vested in the former Board, shall on the commencement of this Law be transferred to the Board and shall by virtue of this Law and without any further assurance vest in the Board.
  3. All the members of staff of the former Board are hereby transferred to the Board and shall be deployed by the Board to such offices as the Board may decided.
  4. Any proceedings or cause of action pending or existing immediately before the commencement of this Law shall be continued or commenced as the case may be by or against the Board instead of the former Board to the same extent that the proceedings or cause of action ought to have been continued or commenced by or against the former Board if this Law had not been made.
  5. Interpretation

In this Law unless the context otherwise requires—

“Board” means Science and Technical Education Board established by section 1 of this Law;

“Chairman” means the Chairman of the Board;

“Governor” means Governor of the State;

“Member” means member of the Board;

“State” means Cross River State.

  1. Short title

This Law may be cited as the Science and Technical Education Board Law.
