EXPLANATORY MEMORANDUM

This Act amends the Advertisement Practitioners (Registration, etc) Act Cap. A7, Laws of the Federation of Nigeria, 2004 to increase the prescribed penalties and transfer appellate jurisdiction from the Court of Appeal to the High Court in a matter under the Act.

ADVERTISING PRACTITIONERS (REGISTRATION, ETC.) (AMMENDMENT) ACT, 2016

An Act to amend the Advertisement Practitioners (Registration, Etc.) Act Cap. A7, Laws of the Federation of Nigeria, 2004 to increase the prescribed penalties and transfer appellate jurisdiction from the Court of Appeal to the High Court in a matter under the Act; and for related matters.

ENACTED by the National Assembly of the Federal Republic of Nigeria—

Amendment of Cap. A7 LFN, 2004

1. The Advertising Practitioners (Registration, etc) Act Cap. A7, Laws of the Federation of Nigeria, 2004 (in this Act referred to as “the Principal Act”) is amended as set out in this Act.

Amendment of Cap A7 LFN 2004

2. Section 18 of the Principal Act is amended by substituting for—

(a)     the words “a maximum fine of one thousand Naira” in line 4, the words, “a fine of five hundred thousand Naira”; and

(b)     the words, “not less than one year or more than three years”, in line 7, “the words, “three years”.

Amendment of section 20

3. Section 20 of the Principal Act is amended—

(a)     in subsection (3) (a). By substituting for the words, “not exceeding five hundred Naira” in line 2, the words, “of one hundred thousand “Naira” and

(b)     in subsection (3) (b), by substituting for the words, “not exceeding one thousand Naira or to a term of imprisonment not exceeding two years”, in line 2, the words, “of five hundred thousand Naira or to a term of imprisonment of two years”.

Amendment of section 28

4. Section 28 of the Principal Act is amended by substituting for the words, “Court of Appeal”, the words, High Court” appearing in—

(a)     the marginal note; and

(b)     subsections (1) and (4)

Citation.

5. This Act may be cited as the Advertising Practitioners (Registration, etc.) (Amendment) Act, 2016.
