EXPLANATORY MEMORANDUM

This Act amends the Transfer of Convicted Offenders (Enactment and Enforcement) Act Cap. T16, Laws of the Federation of Nigeria, 2004.

TRANSFER OF CONVICTED OFFENDERS (ENACTMENT AND ENFORCEMENT) (AMENDMENT) ACT, 2013

An Act to amend the Transfer of Convicted Offenders (Enactment and Enforcement) Act Cap. T16, Law of the Federation of Nigeria, 2004; and for related matters.

Commencement

ENACTED by the National Assembly of the Federal Republic of Nigeria:

Amendment of CapTl6 LFN, 2004

1. The Transfer of Convicted Offenders (Enactment and Enforcement) Act Cap. T16, Laws of the Federation of Nigeria, 2004 (in this Act referred to as “the Principal Act”) is amended as set out in this Act.

Amendment of section 5.

2. Section 5 (1) of the Principal Act is amended by substituting for paragraph (d), a new paragraph “(d)”:

“(d)   if the convicted offender is sentenced to not less than 12 months imprisonment and where both countries agree.”

Deletion of section 8

3. Section 8 of the Principal Act is deleted.
