EXPLANATORY MEMORANDUM

This Act amends the National film and Video Censors Board Act, Cap. N40 Laws of the Federation of Nigeria, 200 to reduce the membership of the Governing Board and empower the Board to regulate the import and export of movies.

NATIONAL FILM AND VIDEO CENSORS BOARD (AMENDMENT) ACT

An Act to amend the National film and Video Censors Board Act, Cap N40, Laws of the Federation of Nigeria, 2004 to reduce the membership of the Governing Board and empower the Board to regulate the import and export of movies; and for related matters.

COMMENCEMENT

ENACTED by the National Assembly of the Federal Republic of Nigeria—

Amendment of Cap N40 LFN, 2004

  1. The National Film and Video Censor Board Act Cap. N40, Laws of the Federation of Nigeria, 2004 (in this Act referred to as “the Principal Act”) is amended as set out in this Act.

Amendment of section 2

  1. Section 2 of the Principal Act is amended by inserting, after paragraph (d), a new paragraph “(da)”—

“(da) to regulate the import of foreign movies and export of Nigeria movies

Amendment of section 3

  1. Section 3 of the Principal Act is amended by substituting for subsection (1), a new subsection “(1)”—

“(1) the Board shall consist of—

(a)     a chairman, who shall be—

(i)      an eminent Nigerian with sound knowledge of the Nigerian arts and culture and requisite experience in the film related discipline, and

(ii)     appointed by the President on the recommendation of the Minister;

(b)     a representative of each of the six geographical zones of Nigeria who shall—

(i)      have sound knowledge of the Nigerian arts and culture and requisite experience in the film related discipline, and

(ii)     appointed by the President on the recommendation of the Minister;

(c)     a representative of—

(i)      the Minister responsible for information, and

(ii)     the Nigerian Copyright Commission;

(d)     3 university lecturers, to be appointed by the President on the recommendation of the Minister; and

(e)     the Executive Director of the Board”.

Deletion of section 15

  1. Section 15 of the Principal Act is deleted.

Substitution for section 60

  1. Substitute for section “60” of the Principal Act, a new section “60”—

Penalty

  1. A person who contravenes the provisions of section 56 – 59 and any other section where no specific penalty was provided, commits an offence and is liable on conviction to a fine of 500,000 or imprisonment for a term not exceeding 3 months or both”.

Citation

  1. This Act may be cited as the National Film and Censor Board (Amendment) Act, 2016.
