Explanatory Memorandum

This Act amends the Nigerian Institute of Animal Science Act, No. 26 of 2007 to properly define the Institute’s regulatory role, enforce the provisions of the Act and provide penalties for breach thereof.

A Bill
For
An Act to amend the Nigerian Institute of Animal Science Act, No. 26 of 2007 to properly define the Institute’s regulatory role, enforce the provisions of the Act and provide penalties for breach thereof; and for related matters

Commencement
ENACTED by the National Assembly of the Federal Republic of Nigeria –

Amendment of Act No. 26.2007.
1. The Nigeria Institute of Animal Science Act, No. 26 of 2007 (in this Act referred to as “the Principal Act”) is amended as set out in this Act.
Amendment of section 1
2. Section 1 (2) of the Principal Act is amended by substituting for the word, “shall” the word, “may” appearing in lines 1 and 2.
Amendment of section 2.
3. Section 2 of the Principal Act is amended by-
(a) substituting for the existing paragraphs (g), (i) and (J), new paragraphs “(g)”, “0)” and “(1)” –
“(g) to promote all animal science activities and welfare of animals to effect efficient and scientific production”;
“(i) to promote and coordinate research efforts and other studies for the advancement of any of the aspects or branches of animal science and to disseminate information relating to research results and modern animal production skills and technology”; and
“(1) to ensure that the curricular and courses of studies in animal science or production of the Faculties of Agriculture or Animal Science in the Universities or Polytechnics are of theoretical and practical relevance to the development and growth of animal science”; and
(b) inserting after paragraph (I), a new paragraph “(m)” –
“(m) to do such other acts and things as may be conducive to the attainment of the functions of the Institute”.
Amendment of section 4
4. Section 4 (2) of the Principal Act is amended –
(a) by substituting for paragraph (c), a new paragraph “(c)” –
“(c) the Registrar who shall be the Chief Executive of the Institute”;
(b) in paragraph (d), by substituting for-
(i) the word “fourteen, the word “fifteen”, in line l , and
(ii) subparagraphs “(xi)” and “(xii)”, new subparagraphs “(xi)” and “(xii)” –
“(xi) animal physiology and bioclimatology”; and
“(xii) livestock production and environment”;
(c) in paragraphs (e) and (f), by inserting after the word “representative”, the words, “who shall be a Registered animal scientist”; and
(d) by substituting for the existing paragraphs (g) – (k) new paragraphs “(g) – (k)” –
“(g) two persons who shall be Registered Animal Scientists to be elected by the Institute to represent the organized private sector in the field of agro-allied industries and another representing the Civil Society Organisations. “
“(h) 6 Deans of Faculties of Animal Science or Provosts of Colleges of Animal Science including the Provost of the NIAS Post Graduate School of Animal Science who shall be Registered Animal Scientists elected based on geopolitical zones”;
“(i) the President of Animal Science Association of Nigeria who shall be a Registered Animal Scientist”;
“(j) Federal Director of Production or Animal Husbandry Services who shall be a Registered Animal Scientist or, in his absence, the most senior Registered Animal Scientist in the Federal Ministry of Agriculture”; and
“(k) the immediate past President, the immediate past Registrar and the two Vice-Presidents shall be ex-officio members of the Council”.
Substitution for section 5
5. Substitute for section 5 of the Principal Act, a new section “5” –
“The elections of Council
5. The President, 2 Vice-Presidents and other members of the Council mentioned in section 4 (2) (a) – (k) of this Act shall be elected by the Institute from amongst the members, at an annual general meeting of the Institute.”

Amendment of section 8
6. Section 8 of the Principal Act is amended by-
(a) in paragraph (a), by substituting for the word, “fees” the expression “subventions, donations” in line 1; and
(b) in paragraph (c), by inserting immediately after the word, “donations” the words, “subject to appropriation by the National Assembly”.
Amendment of section 9
7. Section 9 of the Principal Act is amended by –
(a) deleting the words, “President and”, in lines 3 and 4;
(b) deleting the words, “by signatures of such”, in line 4; and
(c) inserting immediately after the word “Council” the words with extant regulations”, in line 5.

Amendment of section 10
8. Section 10 of the Principal Act is amended by deleting the word, “Investment”, in line 2.

Amendment of section 11
9. Section 11 of the Principal Act is amended by deleting the word, “Borrowing”, in line 2.

Amendment of section 12
10. Section 12 of the Principal Act is amended –
(a) in subsection (1), by substituting for the expression “30th day of September”, the expression” 31st day of December”, in line 2;
(b) in subsection (2), by-
(i) substituting for the expression “315t day of December”, the expression “315t day of March of the subsequent year”, in line 2, and
(ii) inserting immediately after the word, “Agriculture”, the words “whose ministry shall be the supervisory Ministry for the Institute” in line 3.
Amendment of section 13
11. Section 13 (1) of the Principal Act is amended by substituting for the phrase, “of the appointment of Institute Registrar”, the phrase “Registrar and Chief Executive of the Institute”, in line 2.
Amendment of section 14
12. Section 14 of the Principal Act is amended by substituting for the words, “the members including the Associates, Fellows, and Honorary Fellows”, the words “Registered Animal Scientists, Graduate Animal Scientists, Associate members and Fellows of the Institute.”

Amendment of section 15
13. Section 15 of the Principal Act is amended by –
(a) inserting immediately after the word “any”, the word “person”; and
(b) substituting for paragraphs (a) – (d), new paragraphs “(a) – (d)” –
“(a) Registered Animal Scientist;
(b) Graduate Animal Scientist;
(c) Associate Member; or
(d) Fellow.”

Amendment of section 16
14. Section 16 of the Principal Act is amended by substituting for-
(a) the word, “Member”, the words, “Registered Animal Scientist”, in line 1; and
(b) paragraph (a), a new paragraph “(a)”-
“(a) a holder of a Bachelor’s Degree in any animal science discipline or such degree recognized by the Council as equivalent from any accredited institution in Nigeria or abroad and has in addition had 5 years approved post-graduation or post qualification working experience and persons holding foreign degrees shall have to pass a prescribed professional practice examination set by the Nigerian Institute of Animal Science”.

Amendment of section 17
15. Section 17 of the Principal Act is amended-
(a) by inserting immediately after the word, “Associate”, the word “Member
(b) in paragraph (a), by deleting the word, “either”, in line I; and
(c) in paragraph (b), by substituting for the word, “Member”, the word, “person” in line I.

Amendment of section 18
16. Section 18 of the Principal Act is amended –
(a) by substituting for –
(i) the existing opening words “A person is a Member or Associate shall be eligible to be registered as a Fellow if’ for new opening words, “A person shall be eligible to be elevated to the rank of a Fellow of the Institute if “,
(ii) paragraph (a), a new paragraph “(a)”-
“(a) that person has satisfied the requirements of section 16 (a) of this Act”,
(iii) paragraph (b), a new paragraph “(b)” –
“(b) by either research efforts publications or experience in any area of animal science contributed significantly to the growth and development of animal science or related areas or of the Institute and its facilitators”; and
(b) by inserting a new paragraph “(c)” –
“(c) the Council is satisfied that person is a fit and proper person to be elevated to the rank of a Fellow”.

Substitution of section
17. Substitute for section 19 of the Principal Act, a new section” 19″ –
“Honorary
19. The Council may subject to its rules in that regard award distinctive certificates and other honors to any person, member, Associate or Fellow as the case may be for any distinctive achievement in any discipline or area of animal science.”

Deletion of section 20.
18. Section 20 of the Principal Act is deleted. Deletion of section 20.

Amendment of section 21.
19. Section 21 of the Principal Act is amended –
(a) in subsection (1), by inserting the words, “of Agriculture or Animal Science” immediately after the word “faculty” in line I;
(b) in substitution (3), by substituting for the word, “Members”, the words “Animal Scientist”, in line 3; and
(c) substituting for subsections (4 )-(7), new subsections “( 4 )-(7)” –
“(4) Any institution whose animal science program has not been accredited by the Nigerian Institute of Animal Science shall not be allowed to admit candidates for the training of Animal Scientists and the Institute shall have power to direct closure of such programs.
(5) The Institute shall not recognize such certificates issued from such unaccredited programs.
(6) Subject to this Act, a person who has not obtained his first degree or other academic qualification from an accredited institution shall not be eligible to be registered as a Registered Animal Scientist with effect from the time such institution was unaccredited.
(7) Subject to the provisions of this Act, any person who is not a Registered Animal Scientist who parades himself as one is liable on conviction to a fine of ~5,OOO or a term of 3 months imprisonment.’ ,
Amendment of section 23.
20. Section 23 (3) of the Principal Act is amended by substituting for the figure ‘6’, the figure ‘4’.

Amendment of section 24
21. Section 24 (2) of the Principal Act is amended –
(a) in paragraph (a), by inserting immediately the after the word, “any”, the words, “Registered Animal Scientist, Graduate Animal Scientist, Associate, in line 2; and
(b) in paragraph (b), by inserting immediately after the word, “Associate”, the word, “Graduate” in line I.

Amendment of section 26
22. Section 26 (1) of the Principal Act is amended-
(a) in paragraph (b), by inserting immediately after the word, “imprisonment”, the words “of an offence”, in line 2;
(b) by inserting a new subsection “(2)” –
“(2) For the purpose of subsection (1) (b) of this section, a person shall not be treated as convicted unless the conviction stands at a time when no appeal or further appeal is pending or may (without extension of time) be brought in connection with the conviction”; and
(c) by renumbering the section appropriately.

Amendment of section 29
23. Section 29 of the Principal Act is amended by deleting the words, “Proceedings”, in line 3.

Amendment of section 33
24. Section 33 of the Principal Act is amended by redefining the following in alphabetical order-
“Institution” means “Faculty, College, or University offering animal science programme”.
“Institute” means Nigerian Institute of Animal Science established under section I (1) of this Act;
“President” means President of the Council of the Institute;
“Registrar” means the Registrar and Chief Executive of the Institute;
“First Vice-President” means First Vice-President of the Council of the Institute;
“Second Vice-President” means Second Vice-President of the Council of the Institute;
“Council Member” means a member of the Council of the Institute;
“Member” means a member of the Institute and includes a Registered Animal Scientist, Graduate Animal Scientist, Associate Member and Fellow of the Institute;
“Register” means the Register established under section 14 of this Act;
“Rank” means the status of Registered Animal Scientists, Graduate Animal Scientists, Associates or Fellows;
“Fund” means fund of the Institute;
“Animal Science” means the technology involved in the production of food and companion animals which include the science of animal breeding and genetics, the science of animal nutrition, feed ingredients, vitamins and minerals, feed-milling, animal products, equipment and devices, animal husbandry and engaging in teaching or passing instructions in the technology of any discipline or segment of animal husbandry and this excludes traditional rearing of Livestock;
“Registered Animal Scientist” means a person registered by the Institute to practice Animal Science.

Citation.
26. This Act may be cited as the Nigerian Institute of Animal Science (Amendment) Act, 2015.
