HIGH COURT OF LAGOS STATE (FEES) LAW – [L.S.L.N. 6 of 1991. L.S.L.N. 6 of 2001.] 

A Law to prescribe fees payable in proceedings and allied matters in Lagos State High Court and for connected purposes. 

[20th April, 2001]        [Commencement.] 

1.   Fees chargeable 

(1)    The fees chargeable in all High Court proceedings and allied matters in the State High Court are as specified in the Rules set out in the Schedule to this Law. 

(2)    The Rules may be cited as the High Court of Lagos State Fees Rules 2000. 

2.     Revocation of L.S.L.N. 1994 

The High Court of Lagos State (Increase of Fees) Rules Cap. H3 Laws of Lagos State 1994 are revoked. 

3.     Citation and commencement 

This Law may be cited as the High Court of Lagos State (Fees) Law and shall come into force on the 20th day of April 2001. 

SCHEDULE OF FEES 

Schedule A 

Civil Summons 

Fees payable on Civil Summons are as follows: 

1. (A)        For the recovery of specified sum: 

(a)    N250,001, N500,000.00 – N1,000.00 

(b)    N500,001, N,000,000.00 – N2,500.00 

(c)    N1,000,001, N5,000,000.00 – N5,000.00 

(d)    Above N5,000,000 – N7,500.00 

(B)    For the recovery of an unspecified sum: 

(a)    Each Declaration – N250.00 

(b)    Each Order – N50.00 

(c)    Maximum Fees – N1,000.00 

For an account to be taken and payment of the sum found due: 

(a)    INITIAL FEE – N100.00

(b)    SECOND fee payable before setting down for judgement per N1,000 or part thereof found due in excess of N2,000 – N50.00 

(c)    Maximum to the fee – N250.00 

2.     SUMMONS FOR POSSESSION 

(a)    For possession of property as between landlord and tenant N1,000.00 

(b)    For possession of property other than as between Landlord and tenant – N1,000.00 

3.     DECLARATION OF TITLE 

(a)    Declaration affecting land – N1,000.00 

(b)    For other relief of assistance e.g. specific performance – N1,000.00 

4.     PLEADINGS 

(a)    Filing of statement of claim – N100.00 

(b)    Filing of statement of Defence – N100.00 

(c)    Filing Terms of settlement per signatory – N50.00 

5.     ADMINISTRATION SUMMONS 

For the administration of property of a deceased person where there is no dispute regarding succession or distribution. 

(a)    Where the gross value of the property is N1,000.00 – N100,000.00                     N500.00 

(b)    Where the gross value of the property is N100,001 – N250,000.00                      N750.00 

(c)    Where the gross value of the property is N250,001 – N500,000.00                      N1,000.00 

(d)    Where the gross value of the property is N500,001 -1 million:                            N1,500.00 

(e)    Above 1 million or not specified – N2,000.00 

For the administration of the property of person of unsound mind same as under item 5. 

For the determination of a question relating to the distribution or succession to the property of a deceased person to a trust whether the person who created the same be dead or alive. 

(a)    Where the gross value of the property of the deceased or the property under trust does not exceed N100,000.00 –  N1,000.00 

(b)    Where it exceeds N100,000.00 plus N50.00 per N1000.00 or part thereof up to a maximum of N500,000.00 – N100.00 

(c)    Where no gross value can be specified – N5,000.00 

6.     SERVICE AND MILEAGE 

For service of process on one person the mileage is generally assessed thus: 

(a)    Service (per party) – N200.00 

(b)    Mileage (per kilometer) – N20.00 

7.     MISCELLANEOUS 

All matters classified under the above headings are motions, originating summonses. These are numbered M/…………../S.

(a)    The fee payable on a motion supported by an affidavit with one deponent is N350.00 per exhibit.
