LAGOS STATE (CONSTITUENCY) PROJECT DEVELOPMENT LAW

A LAW TO PROVIDE FOR THE SETTING ASIDE OF A MINIMUM OF FIFTEEN PER CENT OF THE ANNUAL CAPITAL EXPENDITURE BUDGET FOR THE PROVISIONS AND MAINTENANCE OF PUBLIC INFRASTRUCTURES IN ALL STATE CONSTITUENCIES, ESTABLISHMENT OF A PROJECT MONITORING COMMITTEE AND FOR OTHER CONNECTED PURPOSES.   

1.       Setting aside 15 per cent of Capital Expenditure Budget

(1)     The Commissioner for Economic Planning and Budget shall, in every year set aside a minimum of 15 per cent o f the annual Capital Expenditure Budget of the State.

(2)     The amount so set aside under the provisions of subsection (1) shall be released quarterly in each year and shall be equally distributed among all the f o r t y ( 40) State Constituencies listed in the Schedule to this Law.

2.      Provision and maintenance of infrastructure

Any amount that may accrue to each constituency under the provisions of subsection (2) of Section 1 shall be used to provide and maintain –

(a)     public infrastructures; and

(b)     basic social amenities, in that constituency.

3.      Project Monitoring Committee and its Composition

(1)     There shall be established in each constituency a committee to be known as the Project Monitoring Committee (referred to in this Law as “the Committee”).

(2)     The Committee shall consist of-

(a)     the member of the House of Assembly representing that constituency as chairman;

(b)     four (4) other members who shall be community leaders in the constituency to be appointed by the chairman taking into cognizance the diversity of the people within the constituency.

4.      Functions of the Committee

The Committee shall-

(a)     determine the type of project the constituency shall embark on in a particular year under this Law;

(b)     convey the decision of the committee under the provisions of paragraph

(a)     of this Section to the appropriate Government agency; and

(c)     monitor the development of such projects and submit quarterly report of its activities to the House of Assembly.

5.      Interpretation

In this law unless the context otherwise requires-

“Committee” means the project monitoring committee established under this Law;

“Government agency” means any Ministry, Department, Parastatal or Bureau appointed by the government for the purpose of this Law;

“House of Assembly” means Lagos State House of Assembly;

“State” means Lagos State of Nigeria.

6.      Citation and Commencement

This Law may be cited as the Lagos State (Constituency) Project Development Law 2000 and shall come into force on the 28th January 2000.
