LAGOS STATE AGENCY FOR MASS EDUCATION LAW

A LAW TO MAKE PROVISIONS FOR THE ESTABLISHMENT OF THE LAGOS STATE MASS EDUCATION AGENCY AND FOR CONNECTED PURPOSES

(1991 No.2)

[Commencement]                                                           [7th January, 1991]

1. Establishment of the Lagos State Agency for Mass Education

(1)     There is established an Agency to be known as the Lagos State Agency for Mass Education (referred to in this Law as “The Agency”).

(2)     The Agency shall be a body corporate with-

(a)     perpetual succession;

(b)     a common seal; and

(c)     may sue and be sued in its corporate name.

2.      Establishment and Composition of the Governing Board

(1)     There is establish a Governing Board (referred to in this Law as “the Board”).

(2)     The Board shall consist of the following members to be appointed by the Governor-

(a)     a seasoned Educationist who shall be the Chairman;

(b)     an Adult Educationist as Director;

(c)     a representative of the Ministry of Youth, Sports and Social Development;

(d)     a representative of the Ministry of Agriculture and Cooperatives;

(e)     a representative of the Directorate of Rural Development;

(f)      a representative of the Inspectorate Division of the Local Government;

(g)     a representative of the Adult Education Department of the Lagos State University;

(h)     two representatives from the Ministry of Education;

(i)      one representative of the National Council of Women Societies;

(j)      a representative of the Ministry of Information and Culture;

(k)     a representative of Women Affairs Department.

(3)     The members, including the Chairman, not being public officers in the Civil Service of the Federal or State Government shall be paid such remuneration as the State Executive Council may determine.

3.      Objectives of the Agency

The objectives of the Agency shall be to-

(1)     eradicate illiteracy in State especially among the rural dwellers;

(2)     provide avenue for vocational programmes to all people outside the formal school system especially those that promote rural development in the State;

(3)     serve as agent of Mass Mobilization for Self Development, Economic Development and Public enlightenment;

(4)     foster positive changes among the people for sound development.

4.      Duties of the Agency

The duties of the Agency shall be to-

(1)     draw up a Master Plan towards the total eradication of illiteracy from the State by the year 2000 and beyond;

(2)     plan, implement, monitor all adult and non-formal educational activities in the State;

(3)     plan, implement and control vocational and continuing education programmes for adults and young persons for enhancement of integrated rural development;

(4)     draw up and implement numerous public mobilization and enlightenment programmes directed towards positive changes for development;

(5)     appoint, promote and exercise disciplinary control the staff of the Agency;

(6)     prepare and implement schemes and conditions of ice for all established staff;

(7)     administer the funds of the Agency;

(8)     perform such other duties that will enhance the smooth running of the Agency.

5.      Secretary and other Staff of the Agency

(1)     There shall be a Secretary to the Agency who shall be the Head of the general administration.

(2)     The Secretary shall be responsible for the-

(a)     day to day administration of the Agency;

(b)     making arrangements for the meetings of the Agency;

(c)     preparing the agenda and the minutes of such meetings;

(d)     conveying decisions of the Agency to its members;

(e)     performing all other duties affecting the Agency as may be assigned to him by the Chairman.

(3)     The Agency may appoint other persons who shall be members of staff or employees of the Agency.

6.      Meeting of the Board

(1)     The Board shall meet on such occasions as the Agency may consider necessary.

(2)     At any meeting of the Board, the Chairman shall preside; in his absence the Director shall preside

7.      Meeting of the Board

The quorum for a meeting of the Agency shall be seven members including the Chairman.

8.      Power to Co-opt

The Agency may co-opt persons who are not members of the Agency to any meeting of the Agency or any Committee and such persons may take part in the deliberations of the Agency or any Committee thereof but shall not be entitled to vote at the meeting of the Agency or any of its Committees.

9.      Power to give directions to the Agency

The Governor may give to the Agency directions relating generally to matters on policy with respect to any of the functions of the Agency under this Law and it shall be the duty of the Agency to comply with such directions.

10.    Financial provisions

(1)     The Agency shall maintain a fund which shall consist of-

(a)     such moneys as may be provided by the State Government by way of loan or grant;

(b)     contributions through philanthropic donations;

(c)     such moneys as may be received by the Agency in the course of its operation or in relation to the exercise of any of its functions under this Law; and from such funds there shall be defrayed all administrative expenses incurred by the Agency.

(2)     Subject to any special direction that may be given by the Governor pursuant to Section 4 of this Law, the Agency may invest its excess funds and maintain a general financial reserve.

(3)     The Agency shall keep proper accounts and records of its receipts, payments, assets and liabilities and shall prepare in respect of each financial year a statement of accounts in such form as the State Government may direct.

11.    Interpretation

In this Law unless the context otherwise requires—

“Agency” means the Agency for Mass Education Established under s.1 of this Law;

“Director” is an adult educationist provided for under section 2(i)(b);

“Governor” means the Governor of Lagos State;

“Programme” means the Mass Education Programme; and

“State” means the Lagos State of Nigeria.

12.    Citation and Commencement This Law may be cited as the Lagos State Mass Education Agency Law and shall come into force on the 7th of January 1991.
