LAGOS STATE RESIDENTS’ REGISTRATION AGENCY LAW

A LAW TO ESTABLISH THE LAGOS STATE RESIDENTS’ REGISTRATION AGENCY AND FOR CONNECTED PURPOSES

(27th of June, 2011)                [Commencement]

THE LAGOS STATE HOUSE OF ASSEMBLY enacts as follows:

1.       Establishment of the Lagos State Residents’ Registration Agency

(1)     There is established the Lagos State Residents’ Registration Agency (referred to in this Law as “the Agency”).

(2)     The Agency shall—

(a)     be a body corporate with perpetual succession and a common seal;

(b)     have power to sue and be sued in its corporate name; and

(c)     be capable of purchasing, acquiring, holding and disposing of movable  and immovable property for the purpose of exercising its functions under this Law.

2.       Establishment and composition of the Governing Board of the Agency

(1)     There is established for the Agency a Governing Board to be known as the Lagos State Residents’ Registration Agency Governing Board (referred to in this Law as the “Board”) which shall be responsible for the administration of the Agency.

(2)     The Board shall comprise of the following:

(a)     Commissioner for Science and Technology, who shall be the Chairman;

(b)     The General Manager of the Agency;

(c)     a representative each of the following:

(i)      Motor Vehicle Administration Agency (MVAA);

(ii)     Lagos State Internal Revenue Service (LIRS);

(iii)    Ministry of Rural Development;

(iv)    Ministry of Science and Technology; and

(v)     Ministry of Health.

(d)     two (2) members of the public who shall be appointed by the Governor on  the recommendation of the Commissioner.

3.       Tenure of Office of members of the Board

(1)     All members of the Board except the General Manager shall serve as part-time members.

(2)     The Chairman and other members of the Board shall hold office for three (3) years and may be re-appointed for another term of three (3) years only.

4.       Remuneration of members of the Board  Members of the Board shall be paid such remunerations and allowances as may be applicable to similar Boards in the State.

5.       Cessation of Office of members

(1)     A member shall be removed from office if –

(a)     by reason of mental or bodily infirmity become incapable of discharging duties;

(b)     convicted of an offence which involves moral turpitude;

(c)     involved in any act that may be considered inimical to the interest of the Agency or the State;

(d)     resigned membership by a notice in writing addressed to the Governor and  shall cease to be a member of the Board on the date of acceptance of the  resignation by the Governor.

(2)     Notwithstanding the provisions of subsection (1) of this Section, the Governor may remove any member of the Board if he is satisfied that it is in the public interest to do so.

6.       Meetings of the Board

(1)     The Board shall meet at such place and time as may be approved by the Chairman.

(2)     The Chairman shall preside at every meeting of the Board and in his absence, the members present at the meeting shall appoint one of them to preside.

7.       Quorum and voting

(1)     The quorum at any meeting of the Board shall be one-third of members including the Chairman.

(2)     All questions at any meeting of the Board shall be determined by a majority vote of members present. Where there is equality of votes, the Chairman or member presiding shall have a casting vote.

8.       Power to co-opt

Where the Board desires to obtain advice or any special information from any person on any matter, the Board may co-opt such person as a member for a limited period and shall have the rights and privileges of a member but shall not be entitled to vote on any issue or count towards a quorum.

9.       Proceedings

(1)     The Board shall have power to make standing orders regulating its proceeding at meetings.

(2)     The validity of any proceeding of the Board shall not be adversely affected by-

(a)     any vacancy in the membership of the Agency;

(b)     any defect in the appointment of a member; or

(c)     reason that a person not entitled to do so took part in the proceedings.

10.     Functions of the Agency

The functions of the Agency shall be to-

(1)     create a reliable database of all residents in Lagos State with a view to–

(i)      providing useful information for social welfare, political, security, business, employment, financial activities, housing and demography statistics for health related matters such as provision of health insurance;

(ii)     facilitating unified planning and implementation of development projects.

(2)     establish the relevant infrastructure for the creation of a residents’ information database for every resident of the State with a view to—

(i)      producing residency cards for all residents of the State;

(ii)     ensuring easy identification of residents;

(iii)    generating health statistics in the State for Health Insurance Scheme;

(iv)    verifying compliance with relevant laws and regulations;

(v)     providing reliable information for making policy planning and implementation.

(3)     produce guidelines for data to be contained in the registration form; and

(4)     advise the government on mode of collecting data from the public.

11.     General Manager of the Agency

(1)     There shall be an officer of the Agency to be known as the General Manager, who shall be the Chief Executive Officer of the Agency and shall be a civil servant not below Grade Level 15 to be appointed by the Governor on the recommendation of the Commissioner.

(2)     The General Manager shall be responsible for the day-to-day management of the human, financial and material resources of the Agency in accordance with the objectives and targets set by the Board.

(3)     The General Manager may resign his appointment with a letter written under his hand or may be removed from office in accordance with the Civil Service Rules.

12.     Secretary to the Agency

(1)     There shall be a Secretary to the Agency who shall be a Civil Servant of not less than Grade Level 12.

(2)     The Secretary shall—

(a)     arrange meetings of the Board, prepare the agenda and take minutes of such meetings;

(b)     convey decisions of the Board to its members; and

(c)     perform all other duties affecting the Board as may be assigned by the Chairman.

13.     Officers and Staff of the Agency

The Agency shall employ directly or on secondment from any Public Service, such number of employees as may be required to assist in the discharge of its functions under this Law and pay to persons so employed such remuneration (including allowances) as are applicable to other officers of equivalent rank in the Civil Service of the State.

14.     Registration

(1)     As from the Commencement of this Law—

(i)      every person residing in the State shall register with the Agency within three (3) months;

(ii)     any person who moves into a long term accommodation in the State after the commencement of this Law shall within thirty (30) days of moving into the accommodation register with the Agency.

(2)     A resident shall notify the Agency of a subsequent change of name or address appropriately.

(3)     Every Landlord, (individual or corporate) in the State shall notify the Agency of any new resident in their premises and shall inform the person of the need to register with the Agency.

15.     Certificate Registration

The Agency shall issue a Certificate of Registration upon registering a resident in the State.

16.     Registration Centres

The Agency shall establish registration centres across the Local Government Councils and Local Council Development Areas (LCDA) in the State and in any other place as deemed fit to facilitate easy registration.

17.     Mobilisation and collation of data by Community Development Council and Community Development Association

Every Community Development Council (CDC) and Community Development Association (CDA) shall mobilize residents and collate data in their respective area.

18.     Unauthorised disclosure of Information

(1)     No officer of the Agency shall disclose any information or data submitted or filed with the Agency without due authorisation;

(2)     The Agency shall put in place necessary machinery to protect all the information/data submitted and filed with it.

19.     Departments of the Agency

There is established the following relevant Departments under the Agency for the purpose of carrying out its functions under this Law-

(a)     General Administration;

(b)     Information Management and Data Processing;

(c)     Accounts; and

(d)     any other Department as may be required for the purpose of the Agency.

20.     Power to make Regulations

The Commissioner subject to the Regulations Approval Law may make regulations generally for carrying into effect the purposes of the provisions of this Law.

21.     Mode of service of document on the Agency

(1)     All documents required or authorized to be served on the Agency under the provisions of this Law or any other law, unless there is express provision to the contrary may be served by delivering same to the General Manager or the Secretary to the Agency, or by sending it by registered post addressed to the General Manager of the Agency at the principal office of the Agency.

(2)     Provided that the Court may, with regard to particular suit or document, order service to be effected in accordance with the terms of such order.

22.     Interpretation

In this Law, unless the context otherwise requires-

“Commissioner” means the Commissioner for Science and Technology;

“A resident” means a person who resides temporarily or permanently in a long term accommodation in the State;

“Governor” means the Governor of Lagos State.

“House” means Lagos State House of Assembly.

“Long term accommodation” means renting a room(s), flat, duplex and whole house for a continuous period of six months and above.

23.     Citation and commencement

This Law may be cited as the Lagos State Residents’ Registration Agency Law and shall come into force on 27th of June 2011.
