PENSION RIGHT OF LAGOS STATE JUDICIAL OFFICERS LAW

A LAW TO TRANSFER FROM THE LAGOS STATE MINISTRY OF ESTABLISHMENT AND PENSIONS TO LAGOS STATE JUDICIAL SERVICE COMMISSION, PAYMENT OF PENSIONS AND OTHER RETIREMENT BENEFITS OF LAGOS STATE JUDICIAL OFFICERS AND FOR CONNECTED PURPOSES [Commencement]

THE LAGOS STATE HOUSE OF ASSEMBLY enact as follows—

1.      Transfer of Responsibility of Pension Benefits

As from the commencement of this Law, the responsibility for the administration and payment of pension of any Judicial Officer who had retired before or will retire after the commencement of this Law, from the Judicial Service of the State, is transferred to Lagos State Judicial Service Commission. The payment of pension of a retiring or retired Judicial Officer of the State shall no longer devolve on or be administered by the Pensions Department of the State Government.

2.      Notice of Retirement

(1)     A Judicial Officer shall serve on the National Judicial Council a Notice of Retirement or intention to retire not less than three (3) months before retirement.

(2)     The Notice shall be—

(a)     sent to the Department charged with responsibility for the administration of Judges Pension Right; and

(b)     filed with other documents connected with the administration and payment of the pension right of the State Judicial Officers, which will enable the State Judicial Service Commission to carry out its functions under this Law.

(3)     The provisions of the Pension Law shall continue to apply and shall, in addition to this Law regulate the pension rights of Judges in accordance with the Constitution of the Federal Republic of Nigeria 1999.

3.      Review of Pension

Pensions of retired Judicial Officers shall be reviewed every five (5) years, when not so reviewed shall be at the same rate with serving Lagos Judicial Officers.

4.      Authentic Age of Judicial Officers

The authentic age of a Judicial Officer shall be the age submitted on entering the Civil Service of the State Judicial Service.

5.      Pension Liability

The Chief Judge of the State shall submit proposed budget needs of Judicial Officers to the State House of Assembly, 1st January and ending 31st December of every year for—

(a)     the standing payments of the State Judicial Service Commission; and

(b)     the pension right of retired and retiring the State Judicial Officers.

6.      Interpretation

In this Law, unless the context otherwise requires-

“Judicial Officer of the State” means the Chief Judge of the State a Judge of the High Court of the State as provided in Section 318 Constitution of the Federal Republic of Nigeria 1999;

“pension” means pension, gratuity or other retirement benefits to any retired Judicial Officer;

“State” means Lagos State of Nigeria.

7.      Citation and Commencement

This Law may be cited as the Pension Right of Lagos State Judicial Officers (Transfer Responsibility and Administration) Law 2007 and shall come into force on 18th day of May, 2007.
