POLICY DIRECTIVES ON INDUSTRIAL POLLUTION CONTROL IN KADUNA STATE. KEPA NOTICE OF 1995, EDICT NO 1 OF 31ST JANUARY 1994.

 

PREFACE

Kaduna State has the second largest concentration of industries in Nigeria and therefore, the second most polluted State in terms of industries, apart from Lagos. Industrial establishments generate all kinds’ of wastes (solid, liquid and gaseous) which are partially treated or untreated and discharged unto the environment.

 

Investigations by KEPA reveal that about 25 million litres of partially treated industrial waste water are discharged into the environment daily; about 125 tons of solid wastes (combined simple and toxic) are generated from the industries and indiscriminately disposed off daily, and unquantified amount of air pollutants (particulation, phenols, CC2, CC, NH3, H2S, SO, NON, etc) are emitted into the atmosphere daily. The level of industrial pollution particularly effluent discharge into River Kaduna necessitates the urgent need to reverse the trend and it is with this view that the Authority prepared these guidelines to assist the industries in their efforts to minimize industrial pollution.

 

Industrial Development must not be used as a reason to destroy the natural environment. The survival of my society depends on its ability to manage its wastes in an environmentally sound manner in accordance with global concept of “Sustainable Development.’ The policy guidelines are therefore to ensure that the environment is not destroyed in the process of development. THE POLICY DIRECTIVES

  1. It is mandatory for all industries which generate treatable wastes to install waste treatment mechanisms/plants or reactivate dormant ones to treat all treatable liquid, solid and gaseous wastes up to KEPA’s standard before discharging such wastes unto the environment;
  2. All industrial establishments to set up waste treatment or pollution control units in their organizations and employ competent professional staff to manage such units;
  3. All industries to install the necessary devices and measures to ensure that all environmental factors in the work place are in conformity with the generally accepted standards to ensure optimal productivity as well as the protection of the health and safety of their workers;
  4. All industries to prepare and submit Environmental Audit Report to KEPA for review and approval. The report is renewed once in three years. KEPA is to respond to such reports within 28 days from the date of submission;
  5. It is mandatory for new industries and for any expansion work in the existing industry to prepare and submit Environmental Impact Assessment (EIA) to KEPA for review and approval before the new project or expansion work is embarked upon. KEPA is to respond to the submission within 28 days from the date of receipt of the report;
  6. Industries and any waste generating Body (including household refuse) are solely responsible for the storage, collection, treatment, transportation and proper disposal of their waste in accordance with the national policy of “Craddle to Grave”; Where an industry engages the services of a contractor or Consultant, the industry must ensure that such a contractor/Consultant is registered with FEPA and KEPA;
  7. To be able to effectively monitor the quality of wastes generated in industries, it is mandatory for every industry to submit monthly report of their waste analysis to KEPA;
  8. For the purpose of instilling industrial pollution control consciousness and awareness in the industries and to encourage them to embark on the provision of pollution control facilities, an Environmental stress fee of one kobo (1k) per litre at the maximum is to be paid by the discharging industry. The charge reduces with increase in the quality of waste water discharged.
  9. When the waste is 100% treated, the discharging industry pays nothing; 10. KEPA to establish and maintain a forum for constant communication with the industrial sector, such a forum already exists in form of the Industrial Pollution Abatement Committee (IPAC);
  10. To ensure strict compliance with item (6) above of this policy, the following charges are approved in respect of solid wastes disposal:

(a)     Simple biodegradable waste (domestic, agricultural etc.) N 10.00/tipper load

(b)     Non-biodegradable wastes (plastics, cons bottle etc.) N10.00/tipper load

(C)     Mixed waste, toxic/harmful (chemicals, poisons, drugs, untreated sludge e.t.c.) N5,000.00/cubic metre

If the toxic waste is treated at source and confirmed to be within FEPA acceptable limit, disposal will attract no charges.

  1. Air emissions from Industrial process must be treated to acceptable limits before they are discharged into the atmosphere. All industries are solely responsible for testing, analyzing treating and proper disposal of their gaseous emissions from source (Starks, boilers, generating plants, compressors etc.)

All untreated gaseous emissions (particulates, Oxides of Sulphur (SO2 SO3 Oxides Nitrogen (NO, NO2, N2O N3O) Hydrogen Sulphide, Ammonia, Hydrocarbons, Volatile Organics, Benzene, Xylene, Toluene, Phenols, Ozone (03) etc.

The charges on the above will be strictly based on level of violation of FEPA standards. KEPA 1995
