KADUNA STATE ENVIRONMENTAL PROTECTION AUTHORITY EFFLUENT LIMITATION AND MANAGEMENT REGULATIONS NO. 3 OF 2009

 

Commencement: 1st January, 2009.

 

In exercise of the powers conferred upon the Authority by section 5(2) of Kaduna State Environmental Protection Edict No. 1 of 1994, and of all other powers enabling me on that behalf, I Mal. Ibrahim Garba Hussaini hereby make the following regulations: –

 

  1. No industry of facility shall release effluent with constituents beyond permissible limits into public drains, rivers, lakes, pools, surface or underground injection, without a waste Discharge/ Disposal permit issued by the Authority or any organization designated by the Authority.

 

2.(i)   The permissible limits of discharge of any effluent in the State is specified in National Guidelines and Standards for Industrial Pollution Control in Nigeria, 1989.

(ii)     Every industry or facility discharging any type of effluent in the state shall comply with the National guidelines and standards for industrial pollution control in Nigeria, 1989.

 

  1. (1) Effluent discharged from any industry or facility shall be analyzed by the industry or facility and report to the Authority every month through an effluent analysis report.

(2)     Any official from the Authority may obtain any sample of effluent from any industry or facility and shall give the owner or person in-charge a receipt describing the sample obtained and in addition he shall leave a duplicate sample with the owner or person in-charge which he could also test if he so wishes for comparison.

(3)     If the analysis of such sample is made, a copy of the result of such analysis shall be furnished to the owner or person in-charge of the industry or facility.

 

  1. No person or corporate body shall engage in the collection, storage, treatment, transportation or disposal of effluent, excreta or sewage, without a permit granted by the Authority.

 

  1. (1) Application for any permit shall be in the forms set out in the schedule to these regulations or as may be specified by the Authority.

(2)     The Authority may revoke a permit issued under section 1 and 2 of this Regulation if the Authority is satisfied that the applicant has not complied with any of the conditions specified by the Authority.

 

6 (1) Every industry or facility shall install pollution control equipment for the detoxification of effluent and chemical discharges emanating from the industry.

(2).    An installation made pursuant to paragraph (1) above shall be based on Best Available Technology (BAT) the Best Practical Technology (BPT) or the Uniform Effluent Standards (UES).

(3)     An industry or facility which discharges effluent exceeding the permissible limits shall treat the effluent to a uniform level to the permissible limits to ensure assimilation by the receiving water into which the effluent is discharge.

 

  1. (1) The Authority shall charge an Environmental Polluter Pay Principle (Environmental Stress Fee ESF) of N2.00/litre to be paid by any industry or facility that discharges effluent that exceeds the permissible limit.

(2)     The industry or facility pays nothing to the Authority as Environmental Stress Fees after treating its effluent to the permissible limits.

 

  1. Every industry in the event of pollution which affects the Environment, shall be responsible for: –

(i)      Cost of cleaning.

(ii)     Remediation/Reclamation.

(iii)    Compensation to affected persons.

 

  1. Every industry or facility shall: –

(a)     Have a pollution monitoring unit within its premises

(b)     Have on site a pollution control equipment, and

(c)     Assign the responsibility for pollution control to a person or corporate body registered by the Authority.

 

  1. Every industry or facility shall submit to the Authority every year beginning: –

(a).    A list of all chemicals used in the manufacture of its products;

(b).    Details of stored chemicals and storage conditions;

(c)     Where chemicals are bought, sold or obtained, the name of any secondary buyer.

 

  1. Any persons who willfully hinders, prevents or obstruct any authorized officer or other person authorized by the Authority in the execution of this Regulations shall be liable to a fine of not less than Five Thousand (N5,000.00) Naira.

 

  1. Any person or corporate body who contravenes any provisions of this Regulation or refuses to comply with an order to a directive by an authorized officer commits an offence.

 

  1. (1) Any persons who commit an offence provided by this Regulations shall be liable for the first offence to a fine not exceeding Fifty Thousand (N50,000.00) naira, or a term of imprisonment not exceeding three months or both; and for subsequent offices, to a fine not exceeding One Hundred Thousand (N100,000.00) Naira or to a term of imprisonment not exceeding six months or both.

 

(2)     For any corporate body, the Chief Executive or the officer in-charge of the organization shall be liable for the first offence to a fine not exceeding Four hundred Thousand (N400,000.00). Naira, or to a term of imprisonment not exceeding Six months or both; and for subsequent offences, to a fine not exceeding One million naira or both.

 

  1. These Regulations may be cited as the Kaduna State Environmental Protection Authority, Effluent limitation and Management Regulations, No. 3 of 2009.

Note:

Every application form for permit must be accompanied with N2,000.00 (or as may be prescribed by the Authority) Bank Draft administration fee in the name of the Kaduna State Environmental Protection Authority.

 

This notice is for all private and public enterprises or facilities intending or already discharging any form of wastes (solid, liquid or gaseous) into Kaduna State ecosystem (including waste disposal Boards and Mining and Mineral Prospecting Companies, on and off farm processing facilities etc).
