EXPLANATORY MEMORANDUM

This Act amends the Utilities Charges Commission Act, Cap. U17 Laws of the Federation of Nigeria, 2004 to review the fines stipulated for offences under the Act.

An Act to amend the Utilities Charges Commission Act, Cap. U17, Laws of the Federation of Nigeria, 2004 to review the fines stipulated for offences under the Act; and for related matters

ENACTED by the National Assembly of the Federal Republic of Nigeria—

UTILITIES CHARGES COMMISSION (AMENDMENT) ACT, 2016

An Act to amend the Utilities Charges Commission Act, Cap. U17, Laws of the Federation of Nigeria, 2004 to review the fines stipulated for offences under the Act; and for related matters

ENACTED by the National Assembly of the Federal Republic of Nigeria—

1.       The Utilities Charges Commission Act, Cap. U17, Laws of the Federation of Nigeria, 2004 (in this Act referred as “the Principal Act”) is amended as set out in this Act.

Amendment of Section 7

2.       Section 7 (2) of the Principal Act is amended by substituting for the expression “N 10,000”, in line 3 the expression “N500,000”;

Amendment of Section 11

3.       Section 11 (5) of the Principal Act is amended by substituting for the expression “N10,000”, in line 3 the expression “N500,000”

Amendment of Section 13 of the Principal Act.

4.       Section 13 (2) of the Principal Act is amended by substituting for the expression “N10,000”, in line 4 the expression “N500,000”.

Amendment of the Second Schedule

5.       The Second Schedule to the Principal Act is amended by –

(a)     deleting paragraphs (a), (b) and (d); and

(b)     re-numbering the existing paragraphs (c), (e), (j), (g), (h), (i) and (j) as paragraphs (a), (b), (c), (d), (e), (f) and (g) respectively.

6.       This Act may be cited as the Utilities Charges Commission (Amendment) Act 2016.
