SAND, LATERITE AND GRAVEL SPILLAGE LAW

A LAW TO PROVIDE FOR THE PROHIBITION OF SPILLAGE OF SAND, LATERITE AND GRAVEL ON THE HIGHWAYS AND OTHER ROADS FOR CONNECTED PURPOSES [Commencement]

[Commencement]                                                                                                           [1st September 1984]

1.      Prohibition of Spillage of Sand, Laterite or Gravel

As from the commencement of this Law, it shall be unlawful for any person to drive any vehicle carrying sand, laterite or gravel without covering the vehicle with tarpaulin or plastic to prevent spillage on the highway or any road in the State.

2.      Penalty for failure to cover Vehicle with Tarpaulin or Plastic

A driver who contravenes or fails to comply with the provisions of section 1 of this Law commits an offence and is liable on conviction to a fine of Forty-Five Thousand Naira (N45,000.00) or three (3) months imprisonment.

3.      Penalty for Spillage on the Highway or other Road

A person who drives a vehicle and negligently or willfully spills sand, laterite or gravel on any highway or roads in State commits an offence and is liable on conviction to a fine of Ninety Thousand Naira (N90,000.00) or six (6) months imprisonment.

4.      Vehicle Inspection Officer to prescribe type of Tarpaulin or Plastic

The tarpaulin or plastic that may be used to cover any vehicle carrying sand, laterite or gravel on the highway or any other road in the State must be as prescribed by the Vehicle Inspection Officer in the State Ministry of Transport.

5.      Prohibition of discharge of Sand

(a)     It shall be unlawful for a person to discharge sand, laterite or gravel on the side of any highway or roads in the State.

(b)     A person who discharges sand, laterite or gravel on the side of any highway or road in the State commits an offence and is liable on conviction to a fine of Forty-Five Thousand Naira (N45,000.00) or three (3) months imprisonment.

6.      Interpretation

In this Law unless the context otherwise requires –

“driver” includes a motor boy or any person in control of a vehicle at the time of commission of offence under this Law;

“Highway” includes Eko Bridge, Western Avenue, Carter Bridge, Third Mainland Bridge, Herbert Macaulay Street, Ikorodu Road, Agege Motor Road, Oshodi-Apapa Expressway, Isolo Expressway, Badagry Expressway;

“Road” means any other road in the State except those defined as “Highway” in this definition section;

“State” means Lagos State of Nigeria;

“vehicle” means trailer, tippers, pick-up vans or any type of commercial vehicle used for carrying sand, laterite or gravel.

7.      Citation and Commencement

This Law will be cited as Sand, Laterite and Gravel Spillage Prohibition Law and will come into force on 1st September 1984.
