CHAPTER I4

ILLITERATES PROTECTION LAW

A LAW TO PROVIDE FOR THE PROTECTION OF ILLITERATE PERSONS AND FOR CONNECTED PURPOSES

1.      Verification of letters written for illiterate person

Any person who writes a letter or document at the request, on behalf   or in the name of an illiterate person must-

(a)     write his own name and address on the document;

(b)     ensure that prior to the document being signed by the illiterate, it was read over, explained in the language understood by the illiterate person;

(c)     state that he was instructed to write the letter or document by the illiterate person and that the letter or document fully and correctly represents his instructions.

2.      Penalty

If the writer of any such letter or document either fails to comply with the provisions of section l(a) and @/ or supplies false information, the writer commits an offence and will be liable on conviction to a fine of ninety thousand Naira (N90,000.00) or to imprisonment for six (6) months.

3.      Legal Practitioners exempt from the provisions of this Law

This Law does not apply to the writing of any letter or other document written in the course of business by or at the direction of any person entitled for the time being to practise as a legal practitioner under the Legal Practitioners Act.

4.      Fee to be Charged

In addition to the obligation imposed on the writer by section l, every writer must state in writing on the letter or document, and on each copy-

(a)     whether or not any fee or reward has been or is to be charged or taken for writing such letter or document;

(b)     the nature or amount of such fee or reward, if any; and

(c)     the total number of copies of such letter or document written, including the original.

For any omission or false statement, the writer shall be guilty of an offence and shall, on conviction be liable to a fine of N90,000.00 (ninety thousand naira) or in default of payment to imprisonment for six months.

5.      Receipt to be given

(1)     Every writer must give a receipt for the full amount of every fee or reward, whether in money or kind, collected for or in connection with the writing of any letter or document.

(2)     A writer who contravenes the provision or subsection (1) above commits an offence and is liable on conviction to a fine of forty-five thousand Naira (N45,000.00) or to a term of imprisonment for three (3) months.

6.      Reward for writing letters

A writer may not charge or take any fee or reward exceeding the rates specified in the Schedule to this Law.

7.      Interpretation

A “writer” means any person who writes any letter or document at the request, on behalf, or in the name of afiy illiterate person, except as provided in section 3.

8.      Citation and Commencement

This Law will be cited as the Illiterates Protection Law and shall come into force on the ……….. day of ……………………..
