A LAW TO REGULATE THE OPERATION OF COMMERCIAL MOTOR CYCLE IN NASARAWA STATE

 

Enactment

BE IT ENACTED by the Nasarawa State House of Assembly and by the authority of same as follows:

 

Citation and commencement

  1. This Law may be cited as Commercial Motorcycle Regulation Law and shall come into operation on the 18th day of September, 2002.

 

Prohibition of riding by under aged persons

  1. No person shall operate or ride a motorcycle for commercial purpose within the State unless he is 18 years old.

 

Offences

  1. It shall be an offence for any person while operating or riding a motorcycle for commercial purposes within the State:

(a)     To wear dark glasses other than on medical grounds.

(b)     To be without valid particulars.

(c)     To carry an extra passenger or goods between the rider’s seat on the handle bar of the motorcycle.

(d)     To be under the influence of alcohol, any intoxicant, drugs or substance that might impair or is likely to impair his sense of judgment or mental ability.

(e)     To tow another motorcycle using his feet or ropes or strings of any sort.

(f)      To be without uniform as may be prescribed by the appropriate authorities.

(g)     To carry passengers sitting side-ways.

(h)     To recklessly or negligently ride same without due care for other road users.

(i)      To have no number plate affixed to the motorcycle.

(j)      Without same being road worth.

(k)     Without side mirrors on same.

(l)      For same not to have mud-flap at the rear mudguard.

 

Registration

  1. (1) No person shall ride a motorcycle for commercial purpose except upon registration with the appropriate authorities.

(2)     The fees to be charged for registration shall be prescribed by the appropriate authorities.

 

[Fines]

  1. Any person who contravenes the provision of this Law shall be liable on conviction by the court to a fine N500 or 3 months imprisonment or both.

 

[Power of Appropriate Authority to make Regulations]

  1. Without prejudice to the generality of the provisions of this Law, the appropriate authorities may make such regulation as it shall deem fit in actualizing the objects of this Law.

 

[Repeals]

  1. The Use of Aprons Edict No. 11 of 1997 and its subsequent Amendment Edict No. 13 of 1998 are hereby repealed.

 

Interpretation

  1. In this Law, unless the context otherwise requires:

“Appropriate Authority” means the Vehicle Inspection Office (VIO) of the State Ministry of Works and Transport and Board of Internal Revenue Service of the State.

“Commercial purpose” means for a fee, charge or consideration.

“Court” means a Magistrate Court.

“Overload” includes carrying goods or passengers between rider’s seat of the motorcycle, carrying more than one passenger at a time but does not include carrying a person with a baby at the back.

“Particulars” includes registration books, driving license, insurance certificate, certificate of roadworthiness and hackney permit. 3

“Rider” means any person that carries passengers or goods on motorcycle for commercial purpose.

“State” means Nasarawa State of Nigeria.
