NASARAWA STATE (ADVISORY COUNCIL ON PREROGATIVE OF MERCY ESTABLISHMENT) LAW

A Law establishing the Nasarawa State Advisory Council on Prerogative of Mercy

 

In exercise of the powers conferred on this House by section 212(2) of the Constitution of the Federal Republic of Nigeria 1999 and of all other powers enabling it on that behalf

BE IT ENACTED by the Nasarawa State House of Assembly and by the authority of same as follows:

 

Citation and commencement

  1. This Law may be cited as the Nasarawa State (Advisory Council on Prerogative of Mercy-Establishment) Law and shall be deemed to have come into operation on 16th day of August, 2000.

 

Establishment of the Council

  1. The Nasarawa State Advisory Council is Prerogative of Mercy is hereby established(hereinafter referred to as “The Council”).

 

Membership of the Council

  1. The Council shall consist of the following Members:

(a)     Attorney General and Commissioner of Justice as Chairman.

(b)     Commissioner of Information & Orientation as Member.

(c)     Commissioner for Women Affairs & Social Development as Member.

(d)     Director of State Security Services

(e)     State Comptroller of Prisons as Member.

(f)      State Commissioner of Police as Member.

(g)     The Director of Public Prosecutions as Secretary.

 

Powers of the Council

  1. (1) The Council shall have the power to make recommendations to the Governor with respect to: Powers of the Governor in consultation with Council on Prerogative of Mercy.

(a)     Confirmation of capital sentences imposed on convicts.

(b)     The pardon, respite for an indefinite or for specified period or commutation of sentences passed on persons convicted of offences,

(c)     Substitution or remission of such punishment or sentences on convicts.

(2)     Without prejudice to the generality of the provisions of this Law, the provision of sub-section (1) of this section shall apply to offences created by any Law of the State.

 

Appointment

  1. All appointments made under section 3 shall be by to Governor.

 

Proceedings

  1. The Council shall regulate its own proceedings.

 

Interpretation

  1. In this Law:

“Council” means the Nasarawa State Advisory Council on Prerogative of Mercy.

“Governor” means the Governor of Nasarawa State of Nigeria,

“Member” means Member of the Council and includes the Chairman,

“State” means Nasarawa State of Nigeria
