PROHIBITION OF TRANSPORTATION, TRADE AND SLAUGTER OF DONKEYS EDICT NO. 6 OF 1999

 

Enactment

The Military Administrator of Nasarawa State of Nigeria hereby makes the following Edict:

 

Title and commendation

  1. This Edict may be cited as the Prohibition of Transportation, Trade and Slaughter of Donkeys Edict and shall come into operation on the ………day of …………………1999.

 

[Interpretation]

  1. In this Edict:-

“Enforcing Agent” means the staff of livestock and veterinary services of the State Ministry of Agriculture and Natural Resources.

“Control Post and Check Points” means those points specially designated for the control movement of donkeys.

“Disease Control Officer” means any person appointed by Director of Livestock and Veterinary Services and such a person shall be;

(a)     A qualified Veterinary Surgeon registered by the Veterinary Council of Nigeria, and

(b)     He is in the employment of the Nasarawa State Government.

“Director” means any officer who at the material time holds the office as Director and has overall responsibility of livestock and veterinary services in Nasarawa State.

 

[Objective]

  1. There is hereby established a law for the protection of donkeys.

 

Permit and fees

  1. The Disease Control Officer or any officer acting in that behalf may be a licensing officer for the issuance of license for the loading and movement of donkeys if he is so satisfied that such movement or loading is not for the purpose of slaughtering for human consumption.
  2. The Fees at the respective rates shall be specified in the First Schedule thereto.
  3. A licence issued under this Edict shall be in form prescribed in the Second Schedule thereto.

 

Production

  1. No person shall disturb, slaughter or posses a donkey within Nasarawa State except as directed by the Disease Control Officer.

 

Production of licence on demand

  1. The holder of a license issued under this Edict, shall on a demand by the Enforcing Agent, Superior Police Officer or any person authorized by the Disease Control Officer produce his licence for Inspection and give any information required concerning any donkey found in his possession or destroyed under a license.

 

[Duration of Licence]

  1. Any license issued under this Edict shall be for a period of twelve months.

 

Issue of search warrant or warrant of arrest

  1. The Enforcing Agent, who is charged with the responsibility under this Edict or under the Schedule to the Criminal Procedure Code Law to arrest without a warrant, shall forthwith communicate to the nearest court so competent or the Local Government Authority who shall then inform the appropriate police office, or to the nearest police officer, that an offence under this Edict has been committed.

 

[Warrant of arrest]

  1. Where it appears to a court or a justice of the peace that an offence is being or has been committed under this Edict the court or the justice of the peace shall issue a search warrant or a warrant of arrest, as the case may be, authorizing the person whom it is addressed to inspect the place or places mentioned in the warrant or for anything specified or described therein or for the arrest of any person specified in such warrant.

 

Power to arrest without warrant

  1. The Disease Control Officer may arrest any person who in his presence contravenes the provisions of this Edict without a permit.

[Arraignment before a court]

  1. Any person so authorized to make an arrest shall without unnecessary delay take or send the person arrested before a court of competent jurisdiction.

 

Offence and penalty

  1. Any person who contravenes any of the provisions of this Edict shall be liable on conviction to a fine of N2,000.00 or imprisonment of 2 months. In addition to any sentences which that court may impose. The Court may also make an order for the forfeiture of any donkeys whether alive or already slaughtered to the Government.

 

Cognizance of an offence

  1. No Court shall take cognizance of an offence under this Edict without the consent in writing of the Disease Control Officer or any other person authorized by him on that behalf.
