COMMERCIAL (HACKNEY CARRIAGE) VEHICLE PERMIT AND OTHER (MISCELLANEOUS PROVISIONS) EDICT 1998

NASARAWA STATE OF NIGERIA

EDICT NO. 2 OF 1998

 

Date of Commencement        1st January 1998

 

Enactment

The Military Administrator of Nasarawa State of Nigeria hereby makes the following Edict:

A Law to provide for the Registration, Identification and Licensing of all Categories of Commercial Vehicles Operating in Nasarawa State

 

Title and commencement

  1. This Edict may be cited as Commercial (Hackney Carriage) Vehicle Permit and Other (Miscellaneous Provisions) Edict and shall come into operation on the 1st day of January, 1998.

 

Interpretation

  1. In this Edict, unless the context requires:-

“Board” means Nasarawa State Board of Internal Revenue.

“Heavy Goods Vehicles” means vehicles that may include but not limited to trailers, luxury buses, tankers, plants, bulldozers, pay loaders, scrappers etc.

“Highway” includes any roadway to which the public have access.

“Impound” means to take and confine in a Police Station or any place designated for confining vehicles that contravene the Edict.

“Light Goods Vehicles” means vehicles that may include, but not limited to pick-up, taxis, buses and others of that category.

 

[Registration to mandatory]

3.(1) Subject to the provision of the Road Traffic Edict and any subsequent legislation made there under, no person shall operate a commercial vehicle, plant or equipment on any high way in the State, unless he is registered under this Edict in the manner prescribed in the First Schedule and have affixed to it an identification mark in the manner prescribed in the Second Schedule.

 

[Prescribed fees for registration: Third Schedule]

  1. There shall be paid for each registration or subsequent registration, the Fees prescribed in the Third Schedule and is renewable at the expiration of one year after registration.

 

[Offences and penalties]

  1. Any person who contravenes the provisions of Section (3) shall be guilty of an offence and shall upon conviction be liable to a fine not exceeding N10,000.00 or to imprisonment not exceeding six months or to both such fine and imprisonment.

 

[Register of commercial vehicles in the State]

  1. The State Motor Licensing Authority shall keep a register on the forms prescribed in the First Schedule of every commercial vehicle in the State.

 

Penalty

  1. (1) Where any commercial vehicle had been registered in accordance with the Road Traffic Edict and Regulations outside the State or in conformity with Section 3 of this Edict, the owner or driver shall at the expiration of such registration renew same in any State of the Federation.

(2)     Any person who fails to comply with the provisions of Sub-section (1) of this Section shall be guilty of an offence and upon conviction be liable to a fine not exceeding N10,000.00.

 

[Fees payable and offence for non-payment]

  1. (1) Subject to the provisions of the Road Traffic Edict and any subsequent legislation made there under, there shall be paid for traffic offences, accident inspection, garage fees, towing fees and other miscellaneous charges, the fees prescribed in the Fourth and Fifth Schedules to this Edict.

(2)     Any person who fails to comply with the provisions of Sub-section of this Section shall be guilty of an offence and upon conviction shall be liable to a fine not exceeding N3,000.00 or to imprisonment not exceeding two months or to both such fine and imprisonment.
