A LAW TO PROVIDE FOR GRANT OF PENSION AND GRATUITY TO GOVERNOR OR DEPUTY GOVERNOR IN NASARAWA STATE

PENSION (GOVERNOR AND DEPUTY GOVERNOR) LAW 2006

 

Enactment

BE IT ENACTED by the Nasarawa State House of Assembly in this legislative session convened as follows:

 

Citation and Commencement

  1. This Law shall be cited as Pension (Governor and Deputy Governor) Law 2006 and shall come into operation on the 4th day of August, 2008.

 

[Entitlement]

  1. Any person who has held office as Governor or Deputy Governor shall be entitled to pension for life at a rate equivalent to the annual salary of the incumbent Governor or Deputy Governor.

 

Pension to be charged on consolidated Revenue Fund

  1. Any Pension granted under this Law shall be charged upon the Consolidated Revenue Fund of the State.

 

Entitlement where Governor vacates office

  1. Where the Governor vacates office by reason of expiration of tenure or voluntary retirement on grounds of ill health, he shall, in addition to the Pension provided for by Section 2 of this Law be entitled to the following:

(i )     A Special Aide not below the rank of Chief Administrative Officer in the State Civil Service, who shall be selected by him.

(ii)     A Personal Secretary not below the rank of level 10 in the State Civil Service, who shall be selected by him.

(iii)    Two drivers and two vehicles that will be replaced every five years.

(iv)    Protocol services within Nigeria.

(v)     Free medical treatment for him and two immediate family members in Nigeria and abroad.

(vi)    A well –furnished and equipped office in a location of his choice within the State.

(vii)   A house valued at one hundred and fifty million naira (N150,000,000.00) In a place of his choice within the State.

(vii)   One Police Orderly not below the rank of inspector and one State Security Detail of equivalent rank.

 

Entitlement where Deputy Governor vacates office

  1. Where the Deputy Governor vacates office by reason of expiration of tenure or voluntary retirement on grounds of ill-health, he shall, in addition to the Pension provided for by section 2 of this Law be entitled to the following:

(I)      A Special Aide not below Grade Level 12 in the State Civil Service, who shall be selected by him.

(II)    A Personal Secretary not below Grade Level 09 in the State Civil Service who shall be selected by him.

(III)   One driver and one vehicle that will be replaced after every five years.

(IV)    Free medical treatment for him and one immediate family member in Nigeria.

(V)     A house valued at one hundred million naira (N100,000,000.00) in a location of his choice within the State.

(VI)    One Police Orderly not above the rank of sergeant and one State Security Detail of equivalent rank.

Inclusion of Governor or Deputy Governor in previous Administration. Payment to next of kin

  1. Nothing in this Law shall exclude an elected Governor or Deputy Governor in previous administrations and who are from this State from Pension as provided by section 2 of this Law.
  2. (1) Where the Governor or Deputy Governor dies in office before the expiration of his tenure, his personal legal representative or a person designated by him during his life time as his next of kin, shall be paid pension pro rata for two years in the case of Governor and one year for a Deputy Governor.

(2)     Any pension payable under sub-section (i) of this section shall be paid for a period expiring at the end of five years after the death of the Governor or Deputy Governor as the case may be, but it shall be lawful for the total to be paid forthwith.

Repeal

  1. The Grant of Pension to Governor and Deputy Governor Law 2006 and any other Law connected thereto in force in the State is hereby repealed.

Interpretation

  1. In this Law, unless otherwise expressly provided or the context otherwise requires,

“Pension” shall include gratuity and any other entitlement due to a Governor or Deputy Governor.

“Governor” or “Deputy Governor” means a Governor or Deputy Governor duly elected under the provisions of the Constitution of the Federal Republic of Nigeria or any other enabling statue.

“State” means Nasarawa State.
